About HushClan

HushClan ("HushClan", "we", "our", or "us") is a platform that enables users to create, manage, share, and translate custom languages, dictionaries, and communication systems (the "Service").

By accessing or using HushClan you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

Eligibility

• You must be at least 13 years old, or the minimum legal age required in your country or territory.
• If you are below the legal age to enter into contracts in your jurisdiction, you must have verifiable permission from a parent or legal guardian, who accepts these Terms on your behalf.
• By using the Service you represent and warrant that you meet these requirements.

User Accounts

You are solely responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account, whether or not authorised by you.
• Notifying us immediately at support@hushclan.com if you suspect any unauthorised access.

We reserve the right to disable accounts that we reasonably believe have been compromised or used in violation of these Terms.

User Content

You retain full ownership of the languages, dictionaries, mappings, phrases, and other content you create ("User Content").

By using HushClan you grant us a limited, non-exclusive, royalty-free, worldwide licence solely to:

• Store, process, and display your User Content to users you intentionally share it with.
• Operate, maintain, and improve the Service.
• Create de-identified or aggregated statistics about Service usage.

This licence ends when you delete your User Content or close your account, except where content has been shared with other users who have not deleted their copies.

You represent and warrant that you have all rights needed to grant this licence and that your User Content does not infringe any third-party rights or violate any law.

Public Languages

Languages marked as Public may be discovered, viewed, and joined by other users of the Service. You remain solely responsible for any content you publish publicly and must ensure it complies with our Prohibited Use policy below.

Prohibited Use

You agree not to use HushClan to:

• Violate any applicable local, national, or international law or regulation.
• Harass, bully, threaten, defame, or abuse any person.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Upload, transmit, or distribute malware, viruses, or any other malicious code.
• Engage in scraping, data mining, or automated data collection without our written consent.
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
• Use the Service for any purpose that is unlawful, fraudulent, or harmful to others.
• Facilitate the generation, storage, or transmission of content that exploits or harms minors.

We reserve the right to investigate and take appropriate action against any violations, including removing content, suspending or terminating accounts, and reporting to law enforcement.

Subscriptions

Certain features of HushClan require a paid subscription ("Premium"). The following terms apply:

• Pricing: All subscription fees are clearly displayed before purchase. Prices are shown inclusive of applicable taxes where required by law.
• Automatic renewal: Subscriptions automatically renew at the end of each billing period (monthly or annual) unless you cancel before the renewal date.
• Cancellation: You may cancel your subscription at any time through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period; you retain access to Premium features until that date.
• Price changes: We will give you at least 30 days' advance notice before increasing your subscription price. Continued use after the notice period constitutes acceptance of the new price.
• Free trials: If we offer a free trial, you may be required to provide payment information. Unless you cancel before the trial ends, your subscription will begin and you will be charged.

Payments & Billing

Payments are processed securely by third-party payment processors. Depending on your platform, your payment may be processed by:

• Stripe — stripe.com/privacy
• Paddle — paddle.com/legal/privacy
• Apple App Store — apple.com/legal/privacy
• Google Play — policies.google.com/privacy

Each processor's own terms and privacy policy govern the handling of your payment data. We never store your full payment card number, CVV, or equivalent sensitive payment data on our servers.

By providing payment information, you authorise the applicable payment processor to charge your chosen payment method for the subscription fees as described at the time of purchase.

Availability & Changes to the Service

We strive to keep HushClan available 24/7 but cannot guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time. Where reasonably practicable, we will provide advance notice of material changes.

Termination

We may suspend or permanently terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms or applicable law.

You may stop using HushClan at any time and may request deletion of your account and associated data by contacting support@hushclan.com.

Upon termination, Sections 4 (to the extent of shared content), 6, 11, 12, 13, and 14 survive.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be error-free, secure, or uninterrupted, or that any defects will be corrected.

Limitation of Liability

To the fullest extent permitted by applicable law, HushClan and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.

Our total cumulative liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total fees you paid to HushClan in the twelve (12) months preceding the claim, or (b) USD $50.

Some jurisdictions do not allow exclusion of implied warranties or limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HushClan is incorporated, without regard to conflict of law principles. If you are a consumer in the European Union, you also benefit from any mandatory protections provided by the law of your country of residence.

Dispute Resolution

We encourage you to contact us first at support@hushclan.com to resolve any dispute informally.

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Nothing in these Terms limits your right to bring a claim before a competent court or statutory consumer-protection body in your jurisdiction.

Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email (if provided) or by displaying a prominent notice within the Service at least 14 days before the changes take effect. Your continued use of HushClan after the effective date of the revised Terms constitutes your acceptance of those changes.
